Healthcare Provider Terms

1. Introduction

These Healthcare Provider Terms ("Provider Terms") govern your use of Treato Private Limited's ("Treato") platform as a registered healthcare provider. By registering as a healthcare provider on Treato, you agree to be bound by these Provider Terms in addition to our generalTerms of Service and Privacy Policy.

2. Eligibility and Verification

To register as a healthcare provider on Treato, you must:

• Hold a valid registration with the National Medical Commission (NMC) or relevant State Medical Council as a Registered Medical Practitioner (RMP)
• Provide accurate and verifiable credentials, including registration number, qualifications, and specializations
• Submit valid government-issued identification
• Maintain active professional liability/malpractice insurance (recommended)

Verification Process: All healthcare provider applications are manually reviewed and verified by Treato. Only approved providers can accept appointments or maintain a doctor profile on the platform. Treato reserves the right to reject or revoke approval at any time.

3. Platform Fees and Commission

By using Treato to receive patient appointments, you agree to the following fee structure:

Fees are subject to applicable taxes (GST). Treato reserves the right to modify the fee structure with 30 days prior notice. Continued use of the platform after fee changes constitutes acceptance.

4. Payouts and Settlements

• Consultation fees (minus platform commission) are settled to your registered bank account
• Settlement cycle: Weekly (every Monday for the previous week's completed consultations)
• Minimum payout threshold: ₹500
• You are responsible for all applicable taxes on your earnings

5. Professional Responsibilities

As a healthcare provider on Treato, you agree to:

• Comply with all applicable laws, regulations, and professional standards, including the Telemedicine Practice Guidelines 2020
• Provide accurate medical advice based on your professional judgment
• Maintain patient confidentiality in accordance with medical ethics
• Respond to appointments in a timely manner
• Not prescribe Schedule X drugs or controlled substances via telemedicine
• Refer patients for in-person consultation when telemedicine is inappropriate
• Maintain accurate and complete medical records for at least 3 years

6. Content and Intellectual Property

You may create and share content on Treato, including posts, articles, videos, and reels ("Provider Content"). By posting Provider Content, you grant Treato:

• A worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, and display your content
• The right to use your content for marketing, promotional, and educational purposes
• The right to use your name, likeness, and professional credentials in connection with your content

You retain ownership of your Provider Content but agree that this license survives termination of your account.

7. Liability and Indemnification

Important: You acknowledge and agree that:

• You are an independent contractor, not an employee of Treato
• You are solely responsible for the medical advice, diagnosis, and treatment you provide
• Treato is not liable for any claims arising from your medical practice
• You will indemnify and hold Treato harmless from any claims, damages, or expenses arising from your use of the platform or your medical practice

8. Prohibited Activities

You agree not to:

• Provide false or misleading information about your credentials
• Practice outside your area of specialization or competence
• Solicit patients to transact outside the Treato platform
• Share patient information with unauthorized third parties
• Engage in any form of kickbacks or referral fees
• Post content that promotes unverified treatments or medical misinformation

9. Account Suspension and Termination

Treato may suspend or terminate your provider account if:

• Your medical registration is suspended, revoked, or expires
• You violate these Provider Terms or our general Terms of Service
• We receive credible complaints about your conduct or quality of care
• You have excessive cancellations or no-shows
• At our sole discretion for any reason with 30 days notice

Upon termination, pending payouts will be settled within 30 days, minus any amounts owed to Treato or refunded to patients.

10. Dispute Resolution

Any disputes arising from these Provider Terms shall be resolved through binding arbitration in Hyderabad, India, in accordance with the rules of the Indian Council of Arbitration. This arbitration agreement does not apply to claims arising from medical malpractice or patient harm, which may be pursued in appropriate courts.

11. Modifications

Treato reserves the right to modify these Provider Terms at any time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of the platform after changes take effect constitutes acceptance of the modified terms.
